FAN ID law : The State Duma adopted in the third reading a draft law on amendments to the Federal Law “On Physical Culture and Sports in the Russian Federation” in terms of introducing a spectator identification system during sports competitions. We are talking about the so-called “fan passports” or Fan ID. MK-Sport is figuring out which document will eventually go for approval to the Federation Council and for the president to sign.
For the first time, “fan passports” or Fan ID s were used in Russia during international football tournaments – the 2017 Conference Cup and the 2018 World Cup. The forthcoming amendments to the legislation, which received the name “Law on FAN ID ” in the media and among fans, were analyzed in detail by MK in the article ” FAN ID is being introduced in Russia – without it they will soon not be allowed to enter stadiums “ on November 25, 2021.
On December 17, the bill passed the third hearing in the State Duma. Now it will be sent for approval to the Federation Council, and then to be signed by the president. And after that they will publish it. The document should come into force on June 1, 2022. During the discussions, amendments were made to the bill. And some of them are essential.
To begin with, it will not be superfluous to remember what exactly it is about and what all this can lead to.
Football fans are actively protesting against the adoption of the law, believing that the FAN ID will become a serious obstacle to going to the stadiums. Some specialists share their point of view.
The main feature of the bill is that it concerns not only fans. As follows from the final text of the bill adopted by the deputies, “a personalized card for attending a sports competition is an electronic document drawn up based on the identification of a spectator, a participant in an official sports competition , as well as another person involved in holding such a competition , for their authentication, carried out in order to ensuring the security of the state, public safety and public order during official sports competitions. ” As a calf from one well-known children’s cartoon used to say, “everyone will be counted.”
The very definition of identification has changed in the course of the discussion. Now it is not “identifying the identity of the audience”, but “identification and authentication”. And it will be mandatory for spectators, participants and other persons involved in the conduct of competitions, determined by decisions of the Government of the Russian Federation .
At the same time, entry ticket forms and other documents for such official sports competitions should contain information on the need to present a valid personalized card at the entrance to the venues of these competitions. The sale of entrance tickets or other documents granting the right to attend the competition will be carried out in the presence of a valid personalized card and compliance with the procedure for identification and authentication. The organizers of the competition will be obliged to authenticate spectators, participants and other persons involved in the conduct of the competition at an information system for identifying fans in accordance with the procedure and composition established by the Government.
The procedure and methods for identifying and authenticating spectators, participants and other persons involved in the conduct of the competition, as well as the composition of information provided by identifiable and authenticated persons, will be approved by the Government. FAN ID law
In order to identify and authenticate spectators, participants and other persons, the fan identification information system may interact with other information systems in the manner established by the Government of the Russian Federation.
It will be possible to apply for a personalized card to the operator of the information system for identifying fans through the federal state information system “The Unified Portal of State and Municipal Services” .

The decision to refuse to issue a personalized card or to suspend its validity is made . FAN ID law
1) if it is necessary in order to ensure the defense capability or security of the state or public order, or if there is information obtained in accordance with the legislation of the Russian Federation or on the basis of international treaties of the Russian Federation about the facts of violation by a spectator, a participant in an official sports competition and other person involved in the conduct of such competitions , public order during public, sports, entertainment and (or) other mass events, including outside the territory of the Russian Federation, or on the intention to commit the corresponding illegal acts;
2) if there is in respect of the person a court decision that has entered into legal force on an administrative ban on visiting the venues of official sports competitions on the days of their holding before the expiration of the term of such an administrative ban;
3) if there is a court decision on the establishment of administrative supervision in respect of the person, and if the court has established an administrative restriction in relation to this supervised person in the form of a ban on visiting places where mass and other events are held and participating in these events before the expiration of such an administrative restriction.
If a decision is made to refuse to issue a personalized card or to suspend its validity, the operator of the fan identification information system notifies the viewer, participant and other person involved in the holding of such a competition about such a decision , indicating the above grounds, in accordance with which the specified solution. The decision to refuse to issue a personalized card or to suspend its validity may be appealed against in court.
The decision to refuse to issue a personalized card or to suspend its validity shall be canceled on the basis of a relevant court decision or upon elimination of the above grounds, in accordance with which such a decision was made.
It goes without saying that violation of the procedure for identification and authentication will entail liability provided for by the legislation of the Russian Federation.
Most of the amendments made during the discussion not only clarify, but most likely toughen the adopted amendments to the “Law on Sports”. It is likely that the massive detentions of CSKA fans after the match with Zenit gave another reason for the supporters of this bill to advocate for its early adoption. We will see how everything will work in practice after June 1, 2022.
